Terms of Service

1. Acceptance

By downloading, accessing or using NudgeBack, you agree to these Terms of Service. If you do not agree, do not use the application.

2. Purpose of the app

NudgeBack is a general productivity and reminder tool. It helps users capture tasks, identify next steps and schedule reminders. NudgeBack is not medical, mental-health, therapeutic, diagnostic or healthcare software.

3. No guarantee of reminder delivery

Reminder delivery is not guaranteed at a particular time or at all. Delivery can be affected by notification permissions, battery optimization, operating-system scheduling, device shutdown, Do Not Disturb settings, app suspension, time-zone changes, platform bugs and other factors outside our control. Do not rely on NudgeBack for emergencies, safety-critical obligations, medication timing, medical decisions or other situations where delayed or missed reminders could cause harm.

4. Your responsibilities

You are responsible for entering accurate task and reminder information, maintaining access to your device, configuring notification permissions and checking important obligations through appropriate independent means.

5. Local data

NudgeBack currently stores core task and preference information locally on your device. You are responsible for device backups and for understanding that clearing app data, device reset, uninstalling the app or platform behavior may remove information.

6. Purchases

Where offered, paid features may be unlocked through Apple App Store or Google Play in-app purchase systems. Pricing, taxes, refunds, payment methods and purchase restoration are subject to the applicable store's terms. We may change the features associated with free and paid tiers for future versions, subject to applicable law and platform requirements.

7. License

We grant you a personal, limited, revocable, non-exclusive and non-transferable license to use NudgeBack for lawful personal or business productivity purposes, subject to these Terms and the applicable app-store license terms.

8. Prohibited use

You may not misuse the app, attempt to interfere with its operation, reverse engineer it except where law expressly permits, distribute unauthorized copies, use it to violate law or infringe the rights of others.

9. Availability and changes

We may update, modify, suspend or discontinue features. Operating-system changes can require technical changes or temporarily affect functionality.

10. Disclaimer

NudgeBack is provided on an “as is” and “as available” basis to the fullest extent permitted by law. We do not warrant uninterrupted operation, exact reminder timing, compatibility with every device, or that the app will meet every user's requirements.

11. Limitation of liability

To the fullest extent permitted by applicable law, TUCKR89 LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for losses resulting from missed reminders, lost local data, device settings, platform behavior, third-party store services or reliance on the application.

12. Third-party platforms

Your use of Apple App Store, Google Play and device operating-system services is also governed by those providers' terms and policies.

13. Termination

You may stop using NudgeBack at any time by uninstalling it. We may restrict access where necessary to protect the app, comply with law or address abuse.

14. Governing law

These Terms are governed by the laws applicable to TUCKR89 LLC, without overriding mandatory consumer protections that apply where you live. Update this section with jurisdiction-specific wording before launch if required by your legal counsel.
